By accessing and using the Tomau.AI website (tomau.ai), you agree to comply with and be bound by these terms and conditions, along with our Privacy Policy and Cookie Policy. If you do not agree with any part of these terms, please do not use our services.

2. Service Description

3. Usage Rights

We grant you a limited, non-exclusive, and revocable right to use the website to:

• Interact with the community

4. Usage Restrictions

You are NOT ALLOWED to:

• Use the website for illegal purposes
• Violate intellectual property rights
• Distribute harmful or inappropriate content

5. Intellectual Property

Intellectual property owned by Tomau.AI, including but not limited to:

These assets belong to Tomau.AI; you may not copy, distribute, or create derivative works without permission. The coloring page gallery, however, is aggregated from various sources, and Tomau.AI does not claim ownership of all images in it. If you are a copyright holder and find your work on the website, we will promptly remove it via our DMCA complaint process.

6. User Content

When you share content on the website:

• You retain ownership of your content
• You grant us the right to use, display, and distribute
• You ensure the content does not violate others' rights
• You are responsible for the content you share
• We reserve the right to refuse or remove inappropriate content

7. Disclaimer

The website is provided "as is" and we do not guarantee:

We reserve the right to modify these terms at any time. Changes will take effect immediately upon posting. Continued use of the website after changes constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by and interpreted in accordance with the laws of Vietnam. Any disputes will be resolved at the competent court in Vietnam.

12. Mobile Application (iOS)

These Terms also govern our iOS coloring app. The following applies to the app in addition to everything above:

• The app is free to download. Every coloring page, the coloring tools, the drawing lessons and saving your artwork are free. AR Drawing includes a number of free sessions each day.
• Mochi Color Pro is an optional in-app purchase that removes the daily AR Drawing limit. It is offered as a monthly or yearly auto-renewing subscription, or as a one-time lifetime purchase. The price and billing period are shown in the app before you buy.
• Payment is charged to your Apple ID account when you confirm the purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and the renewal is charged within the 24 hours before the period ends. You can manage or cancel subscriptions in your App Store account settings at any time.
• If a free trial is offered, any unused portion of it is forfeited when you purchase a subscription.
• Purchases are processed by Apple. Refunds are handled by Apple under its policies and can be requested at reportaproblem.apple.com.
• You may colour, save and share the artwork you create for personal, non-commercial use.
• You may not extract, redistribute or resell the line art itself, whether in bulk or individually.
• Creating an account is optional. You may delete your account and all associated data at any time from within the app.
• This licence is between you and Tomau.AI only. Apple is not a party to it and is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to conform to a legal requirement, and claims arising under consumer protection or similar legislation.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
